On June 26, 2018, the City Council approved the Final Map for Whitney Ranch Phase II-E Unit 52A (Resolution No. 2018-164) and the Final Map was recorded in Book EE of Maps, Page 18, July 10, 2018. A condition of this map was the dedication of three (3) Landscape lots to be owned and maintained by the City of Rocklin. Landscape Lot B is currently owned by the City, pursuant to Dedication in Fee on the Final Map of Whitney Ranch Phase II-E Unit 52A, recorded in Book EE of Maps, Page 18, on July 20, 2018, and Resolution No. 2019-16 of the City Council of the City of Rocklin accepting the public work, and approving the Notice of Completion recorded in Document number DOC 2019-0004627-00 on January 25, 2019. Lot B is adjacent to residential Lot 31, currently owned by The New Home Company Northern California LLC, a Delaware limited liability company.
A masonry block sound wall was conditioned to be constructed just within the Lot B side of the property line between Lots B and 31, and is owned and maintained by the City of Rocklin. The wall was inadvertently constructed approximately 2’ within Lot B. Staff has determined the remaining portion of Lot B is sufficient for the landscaping purpose for which it was dedicated, and this approximately 2’ strip of City-owned and maintained land is no longer needed for that public purpose. To dispose of this portion of City-owned and maintained property located within the side yard of residential Lot 31, the City has determined that, pursuant to Government Code section 66477.5, the City must transfer the small area of land to the original subdivider, or its successor-in-interest, The New Home Company Northern California LLC, via a Lot Line Adjustment, with accompanying grant deeds for the resultant parcels to be recorded with the County of Placer. Pursuant to Government Code section 66477.5, subdivision (d), the original subdivider, Sunset Ranchos Investors, LLC, has been notified of this proposed transfer and has stated that they have no objections.
