Adopt a Resolution of the City Council of the City of Rocklin Authorizing the City Manager to Execute a Purchase and Sale Agreement and Related Documents for the Purchase of a Portion of Property and a Temporary Construction Easement at 3800 Rocklin Road (APN 010-170-021-000) for the Rocklin Road at Pacific Street Roundabout Project, and Authorizing Waiver of the Replacement Sign Inspection/Permit Fees.
BACKGROUND:

The Rocklin Road at Pacific Street Roundabout Project was initially approved by the City Council on June 15, 2015, Resolution No. 2015-171, and has been approved in subsequent Capital Improvement Plans and fiscal budgets. This project consists of the design and construction of a multilane roundabout to be located at the intersection of Rocklin Road and Pacific Street for the purposes of existing and future traffic relief.

Congestion Mitigation Air Quality (CMAQ) funding has been approved for this project; however environmental delays have been experienced which have significantly impacted the timetable for this project. Staff has continued to move forward on the project design, which is complete and the City Council approved resolution 2019-178 on July 9, 2019, that authorized the City Manager to move forward with Rights of Way discussions and negotiations in order expedite the project after the environmental clearances were received.

The City has recently received the environmental clearances and is ready to move forward with the next step in the process, the purchase of the Rights-of-Way (ROW), which is a portion of the property located at 3800 Rocklin Road (see Exhibit A).  All needed ROW were valued by a professional independent appraiser and staff entered into discussions with the Felora Corporation to purchase approximately 1,169 Sq. Ft. located in the north westerly corner of the parcel, as well as the related temporary construction easement. 

Staff negotiated the final purchase price of seventy-six thousand two hundred and fifty dollars ($76,250.00), which will be payable in one lump sum. In addition, the property owner has requested the City waive the City’s sign inspection/permit fee (minimum $127) necessitated by the relocation of the business sign from the ROW property.

The purchase and sale agreement provides that the City will pay the escrow fees, which are anticipated to be three thousand two hundred dollars ($3,200.00). The Pacific Roundabout Project is funded 100% with CMAQ funds and is included in the Fiscal Year (FY) 2020/21 budget. No additional budget appropriations are necessary at this time.

Fiscal Impact:

The CMAQ funding (240) for this project was included in the FY 2020/21 budget. An additional budget appropriation is not necessary.
