Adopt a Resolution of the City Council of the City of Rocklin Awarding the Contract for the ADA Ramps & Concrete Services  Project to PBM Construction, Inc. and Authorizing the City Manager to Execute the Agreement.


BACKGROUND:

The ADA Ramps & Concrete Services Project (Exhibit A) was included in the Fiscal Years (FY) 2022-2026 Capital Investment Plan (CIP) and the FY 2021/22 operating budget approved by the City Council on June 22, 2021.  This project consists of the construction/retrofit of ADA ramps and concrete services such as the construction of sidewalks, and concrete flatwork that can be used throughout the City.  This is part of the general repairs necessary to upkeep City sidewalks, curbs, and gutters in the coming years.

 

The invitation for bids for the ADA Ramps & Concrete Services Project was advertised on August 6, 2021, and August 13, 2021, with the bid opening on August 24, 2021.  Four (4) bids were received, as listed below, with NFB Engineering, Inc. submitting the lowest bid (Exhibit A). Following the Public Contract Code sec. 5103, NFB Engineering, Inc. withdrew their bid after discovering a substantial mathematical error. PBM Construction, Inc. submitted the next lowest bid in the Amount of $249,549.

The bid package consisted of a bid schedule that provided the costs on a per item/task basis with a quantity identified for bidding purposes. The bid item/tasks costs can be used on various budgeted maintenance and projects in a given year. While the bid amounts established the cost for various items with a total amount for bidding purposes, the actual amount for ADA Ramps and Concrete Services and applicable approved CIP projects would be the not-to-exceed amount of $300,000 for the first nine month period of the agreement.

 

This is an annual contract and is awarded for an initial nine month period.  It is renewable on an annual basis on the same terms, for two additional one-year terms at the City’s option. Once the contract is executed staff will issue work orders on a per job basis throughout the year.

 

Staff has reviewed the bids for sufficiency and recommends that the City Council award the bid to PBM Construction, Inc. for an initial nine month term, in the not-to-exceed amount of $300,000.  Staff also recommends the City Council authorize the City Manager to renew the contract, on the same terms, for up to two additional one-year terms, for a total contract amount of $900,000. Should the City exercise the renewal options, staff will provide the contractor with the updated not-to-exceed amount for that period based on the maintenance and project plan, and funding availability of the budget adopted for the applicable fiscal year. It is anticipated that generally, the annual cost for the services will be approximately $300,000.


Environmental Analysis:

The City of Rocklin’s Environmental Coordinator has reviewed the ADA Ramps & Concrete Services and determined that it falls under the previously approved Notice of Exemption for the City’s road resurfacing projects, Resolution of the City Council of the City of Rocklin 2019-236, and is exempt from review under the California Environmental Quality Act (CEQA) pursuant to California Code of Regulations Section 15301 & 15302.


Fiscal Impact:

The total not-to-exceed amount for the initial nine month period is $300,000. These purchases will be made on an as needed basis and charged to the appropriate jobs/projects included in the Approved FY 2021/22 operating and CIP budgets in various funds for the construction/retrofit of ADA ramps and concrete services.
