Staff Recommendation:

A. The summary of Employment Agreement Key Terms below shall be read aloud in accordance with the Government Code section 54953(c)(3) which states the legislative body shall “orally report a summary of a recommendation for final action on the salary, salary schedule, or compensation paid in the form of fringe benefits” during the open meeting in which the final action is taken.

B. Adopt a Resolution of the City Council of the City of Rocklin Appointing Sheri Chapman to the position of City Attorney and Authorizing the Mayor to Execute the Employment Agreement with the City Attorney.
BACKGROUND:
The City Attorney position became vacant on May 8, 2018, due to the appointment of outgoing City Attorney Steven Rudolph to the City Manager position. Thereafter, a Council ad hoc committee, consisting of Mayor Ken Broadway and Councilmember Greg Janda, was appointed to oversee the recruitment of a new City Attorney.

The City entered into a Professional Services Agreement with Bob Murray & Associates to conduct the recruitment on behalf of the City. Following the conclusion of the application period, the Council ad hoc committee reviewed all applications submitted and recommended 5 candidates for interviews with the City Council. The City Council interviewed all recommended candidates on August 13, 2018.

Based on the candidate qualifications and interviews, the Council authorized negotiations with Sheri Chapman. The negotiations, involving the Council ad hoc committee, have resulted in the Employment Agreement presented to the City Council today for consideration, which is attached hereto as Exhibit “A” to the resolution authorizing execution of the Agreement. The terms of the agreement are summarized below.

Employment Agreement Key Terms:

• The term of the proposed agreement is for a four (4) year term beginning approximately October 1, 2018, through September 30, 2022. The Agreement may be terminated by the City Council at any time with or without cause.
• The proposed City Attorney salary is $201,960 annually. No automatic increases are provided except as authorized by the City Council.
• The City Attorney shall receive all benefits accorded to non-public safety City department heads unless otherwise provided in the Agreement.
• The City Attorney shall receive $12,000 per year City-paid contribution to a deferred compensation plan.
• The PERS retirement benefit shall be according to the 2% @ 55 formula for Classic members. Contributions to CalPERS by Employee and Employer shall be consistent with the Management and Confidential Employees Agreement adopted by the City Council from time to time.
• The City Attorney shall receive a City-paid basic life insurance plan in the amount of $200,000 and a policy for accidental death and dismemberment for up to $200,000.
• The City Attorney shall receive sick leave, vacation, and management leave, and health and retiree health benefits in the same manner as those of Management and Confidential Employees. 40 hours of vacation leave shall be credited upon the effective date of the Employment Agreement.
• A $500 per month allowance for car and cell phone is included in the benefits.
• The severance provision provides for a six month severance package for termination other than for cause with any severance pay limited to 6 months.
