Subject:Sunset Whitney Recreation Area Deed Restriction for Proposition 68 Grant Funding

Staff Recommendation:

Adopt a Resolution of the City Council of the City of Rocklin Approving and Authorizing a Deed Restriction at the Sunset Whitney Recreation Area and Authorizing the Execution and Recordation of the Deed Restriction on Behalf of the City.

BACKGROUND:

On March 23, 2021, the City Council authorized staff to apply for Proposition 68 grant funding applications for PER Capita and Recreational Infrastructure Revenue Enhancement (RIRE) program grants (Resolutions No. 2021-45 and No. 2021-46), to improve the Sunset Whitney Recreation Area (SWRA) East Trails Phase I. As part of the conditions of approval for said grants, the City must record a deed restriction for the property where grant funds are used for improvements. This deed restriction remains for a duration of 30 years, until June 30, 2048.

 

Deed restriction will apply to grant-funded trail improvements on the following SWRA properties: APN 030-140-009-000, APN 016-010-007-000, APN 010-010-011-000. Staff have attached an overhead map of the parcels included in the proposed deed restriction (Exhibit A to Exhibit 1 of the Resolution) with the project area identified where grant funds were used in red highlight. 

 

The SWRA East Trails Phase I improvement project is nearly completed. Staff recommends the recordation of a deed restriction at Sunset Whitney Recreation Area, as it was a condition of approval of the grants, and is necessary to receive the grant funds for the work performed as described in the grants.

Fiscal Impact:

The City was awarded $427,952 for the Per Capita ($177,952) and RIRE ($250,000) grants. The Per Capita Grant Program required a 20 percent match with City funds. The Park Development Fee Fund of $35,591 was used for the grant match. The Park Development Fee funds were used to front the project costs and if a deed restriction is not recorded, the City will be ineligible for grant funding reimbursement.
