The "ADA Transition Program - HUD Specific Areas" project was included in the 2023-27 Capital Improvement Plan and the Fiscal Year (FY) 2022/23 Budget approved by the City Council on June 28, 2022.
The US Department of Housing and Urban Development's (HUD) Community Development Block Grant (CDBG) funding is a resource the City uses to address a wide range of unique needs in the community, including curb ramp construction and sidewalk improvements to achieve compliance with the Americans with Disabilities Act (ADA) .
This project consists of the construction/retrofit of ADA ramps and concrete services such as the construction of sidewalks, and concrete flatwork in the areas of the City that meet HUD/CDBG criteria (see Exhibit 1 for a location map). This is part of the general repairs necessary for the upkeep of the City’s sidewalk, curbs, and gutters in the coming years.
The ADA Ramps & Concrete Services Bid was advertised on July 9, 2022, and July 16, 2022, with the bid opening on July 25, 2022. Three (3) bids were received from the following (see Exhibit 2 for the bid sheet):

The bid package consisted of a bid schedule that provided the costs on a per item/task basis with a quantity identified for bidding purposes. The bid item/tasks costs can be used on various budgeted maintenance and projects in a given year. While the bid amounts established the cost for various items with a total amount for bidding purposes, the actual amount for ADA Ramps and Concrete Services and applicable approved CIP projects would be for the total amount not to exceed $200,000 for the initial ten (10) month period of the agreement.
This is an annual contract and is awarded for an initial ten (10) month period. It is renewable on a year-to-year basis for two (2) additional one-year terms at the City’s discretion. Once the contract is implemented staff will issue work orders on a per job basis throughout the year.
Staff has reviewed the bids for sufficiency and recommends that the City Council award the contract to PBM Construction, Inc. for an initial ten (10) month term, in the amount not to exceed $200,000. Staff also recommends the City Council authorize the City Manager to renew the contract, on the same terms, for up to two (2) additional one-year terms, for a total contract amount not to exceed $600,000. Should the City exercise the renewal options, staff will provide the contractor with the updated not-to-exceed amount for that period based on the maintenance and project plan, and funding availability of the budget adopted for the applicable fiscal year. It is anticipated that generally, the annual cost for the services will be approximately $200,000.
