Staff Recommendation:

Adopt a Resolution of the City Council of the City of Rocklin Accepting Development Impact Fee Reports for the Period Ending June 30, 2022 as Required by Government Code Sections 66000 Et Seq.

BACKGROUND:

In 1987, the California Legislature passed Assembly Bill 1600 (AB 1600), also known as the Mitigation Fee Act (Gov. Code, Sections 66000 et seq.), which governs the establishment and administration of development impact fees. A development impact fee is a monetary exaction other than a tax or special assessment that is charged by a local agency to new development for the purposes of defraying costs of public facilities needed as a result of impacts created by the new development.

Development impact fees are segregated and placed in special funds or accounts, which earn interest. AB 1600 requires local agencies that impose impact fees to provide the public annually with a report that reflects:

(1) the beginning and ending balances of each separate impact fee fund;
(2) the amount of fees collected and the interest earned for the year;
(3) the amount of expenditures and refunds made in the year;
(4) the percentage of project expenditures paid for by fees, and;
(5) a description of the type of fees and the fee amount.

Discussion
As of June 30, 2022, the City had seven separate and distinct development impact fees that are collected, pursuant to AB 1600. The following is a summary listing of the fees, along with the balance for each fee account, as of June 30, 2022:

Findings and Conclusions
The Reports have been prepared by staff and the reports provide information that meets the annual reporting requirements described in the Government Code for each City development impact fee. The reports are part of the Resolution before the City Council and are listed as Exhibits A-G.

Once adopted, these Development Impact Fee reports (AB 1600) will be posted on the City's website.

Fiscal Impact:

There is no fiscal impact resulting from the preparation of these reports.
